Wrongful Death Cases

A wrongful death lawsuit seeks monetary damages from someone whose negligence caused a death.

The types of accidents or incidents in which wrongful death lawsuits can be filed are numerous.  These include fatalities involved in the following:

  • Car crashes
  • Bicycle crashes

Examples of accidents that may lead to a successful wrongful death lawsuit include:

A motorist's negligence causing fatal injuries to another person or persons:  For instance, a motorcycle accident may occur after a motorist makes a left-hand turn immediately in front of an oncoming motorcycle.  If a collision occurs and the motorcyclist is killed, there may be grounds for getting compensation for this death.  One of the primary determinations is if the accident is determined to be the fault of the motorist.

Other motorists driving while intoxicated or driving while impaired by drugs:  In the Chicago area, there have been many accidents causing death involving drunk drivers.  As well, over the last few years there has been substantial growth in accidents involving drug-impaired drivers.  Often, accidents involving these impaired drivers result in fatalities.  One type of accident in which impaired driving is often involved is "wrong-way driver" crashes.  In these crashes in which one party is plainly at fault for the fatality, a wrongful death case is often filed.

Other "head-on collisions":  When a driver crosses the center line there is potential for a "head-on collision" between that vehicle and an oncoming vehicle.  While these types of loss of control accidents can occur for various reasons, one reason is that the driver who crosses the center line is driving while distracted.  A short period of driver inattention can cause the driver to cross the center line.  Another possible cause for this type of crash is drowsy driving.  Such "head-on collisions" are often highly physically traumatic to all vehicle occupants, and the great physical forces often lead to life-threatening injuries.  If the driver (or other vehicle occupant) in the vehicle struck by the wayward driver dies due accident injuries, filing a wrongful death lawsuit may be appropriate.
